After that point, you may not be able to rely on the "I didn't know" defense. until it's publicly known those samples are illegal. You can be held liable for using infringing materials that you acquired from someone else, but one of the usual criteria is that you had to be in a position to stop the initial infringement which wouldn't be the case with the Vengeance packs.
